COMMISSION AND ARTWORK RESERVATION TERMS
These terms apply to commissioned artwork and reservations of unfinished, in-process artwork created by Lane Ross-Sheffield and offered through LRS Gallery.
Artist and Representative
The artist is Lane Ross-Sheffield.
Eric Ross-Sheffield is authorized to act on behalf of Lane Ross-Sheffield and LRS Gallery in connection with commission inquiries, negotiations, pricing, contracts, payments, scheduling, shipping arrangements, licensing discussions and other business-related matters.
The artist or his representative may consult or involve attorneys, accountants, shipping professionals or other advisors when reasonably necessary.
Commission Acceptance
Submitting a commission request does not obligate the artist or LRS Gallery to accept the project.
A commission is accepted only after:
• The project has been reviewed and approved
• The parties have signed a written commission contract
• Payment has been received in full
The written commission contract will identify the requested subject, approximate dimensions, preferred palette, inspiration, requested timing and other relevant project details.
If a signed commission contract conflicts with these general terms, the signed commission contract will control.
Artistic Interpretation
A commission is an original artwork created through Lane Ross-Sheffield’s artistic interpretation of the client’s request.
Reference photographs, colors, dimensions, inspiration and other information supplied by the client are creative direction—not instructions for an exact reproduction.
The finished artwork will not be an exact copy of a reference photograph, another artwork, a digital rendering or another artist’s work. Composition, color, proportion, detail, brushwork, materials and other creative decisions remain within the artist’s discretion.
By commissioning Lane Ross-Sheffield, the client acknowledges that the artist’s individual style and interpretation are essential parts of the commission.
Payment
Commissioned artwork must be paid in full when the commission contract is signed unless a different written payment arrangement is included in the contract.
Work will not begin until the signed contract and required payment have been received.
Commission payments are non-refundable once the contract has been signed and payment has been accepted, except where the artist or LRS Gallery is unable to perform, the contract provides otherwise or applicable law requires otherwise.
Completion Estimates
The client will receive an estimated completion date or completion range.
Completion estimates are provided in good faith but are not guaranteed deadlines. Completion may be affected by seasonality, the artist’s schedule, material or product availability, drying or curing requirements, illness, unexpected creative or technical considerations and other circumstances outside the artist’s reasonable control.
LRS Gallery will make reasonable efforts to communicate material delays and provide an updated estimate.
A delay in the estimated completion date does not constitute a breach or entitle the client to a refund unless the signed contract or applicable law provides otherwise.
Client delays in providing information, photographs, approvals, delivery details or other requested materials may extend the completion estimate.
Progress and Revisions
LRS Gallery or the artist may provide progress information or images as a courtesy but is not required to provide continuous updates unless the commission contract states otherwise.
Once work has started, the artist will reasonably consider client feedback. However, revisions, repainting, compositional changes and other alterations cannot be guaranteed.
Any requested change that materially differs from the original commission may be declined or may require an additional fee and revised completion estimate.
The artist retains final creative authority over the work.
Completion and Delivery
LRS Gallery will notify the client when the commission is complete.
Shipping, insurance, packing, crating, delivery and applicable taxes or fees are the client’s responsibility unless the signed contract expressly states otherwise.
The Shipping and Delivery Policy applies to commissioned artwork.
Final Sale
Because commissioned artwork is created specifically for the client, all commissioned artwork is final sale and may not be returned or exchanged.
Reference Materials
The client represents that the client owns or has permission to provide and use any photograph, image, trademark, design or other reference material submitted for the commission.
The client is responsible for claims arising from reference materials supplied without the necessary permission.
Photography and Publicity
The artist and LRS Gallery may photograph or record commissioned artwork and may use those images for portfolios, exhibitions, websites, social media, advertising, editorial coverage, archival records and other promotional or professional purposes.
If the commission is intended as a gift, surprise, confidential project or time-sensitive announcement, LRS Gallery will withhold public posting until the date agreed upon in writing.
Ownership and Copyright
Ownership of the physical artwork transfers to the client only after all amounts due have been paid in full.
Purchase of the physical artwork does not transfer copyright, reproduction rights, licensing rights, merchandising rights or other intellectual-property rights.
Those rights remain with Lane Ross-Sheffield unless they are transferred or licensed through a separate written agreement signed by the artist or an authorized representative.
